Rural I-526E petitions are assigned for adjudication first under a FIFO approach, fulfilling the RIA's statutory priority processing mandate.

Other Categories Follow

High Unemployment, Infrastructure, and Unreserved petitions are assigned after the Rural queue is cleared or sufficiently processed. USCIS may create sub-queues to facilitate set-aside visa usage.

What This Means: Your "place in line" is no longer determined solely by filing date. It now depends on: (1) your project type, (2) whether your project's I-956F is approved, and (3) your visa sub-category. Rural investors benefit most. HUA and Infrastructure investors could face longer waits.

Why Filing Now Matters

Perhaps the most urgent factor for prospective EB-5 investors in 2026 is the grandfathering deadline. The RIA reauthorized the Regional Center program through September 30, 2027, but included a grandfathering clause that only protects petitions filed on or before September 30, 2026.

If you file your I-526E before this deadline, your petition is legally "grandfathered" — meaning USCIS must continue processing it even if the Regional Center program lapses.
